Terms of service

Contract version: 2026-09-16. These terms describe the web service, its APIs and iPhone app. Services are offered primarily to freelancers for their professional activity. Identify your use and billing details correctly. Consumer status depends on actual use, not simply a label.

Factivo.ai collects and organizes documents and transactions, suggests extractions and classifications, prepares informational calculations, enables record sharing and provides an AI assistant. Specific coverage and prices appear on the Pricing page. Gmail and messaging channels are optional.

The application does not replace a tax, accounting or legal adviser. These features do not file returns or initiate tax payments. Drafts are not official forms. Review originals, the tax year, territory, regime and applicable rules with your professional before recording or declaring amounts. Tax savings and eligibility for deductions are not guaranteed. Forwarding an existing document does not certify an invoice-issuing system as compliant with VERI*FACTU.

• Provide accurate information, protect your sign-in methods and notify us of suspected unauthorized use.
• Upload only documents and data you are authorized to process. You are responsible for the lawfulness of your instructions concerning third-party data; the applicable processing agreement must define both parties’ obligations.
• Review AI results. Do not enter secrets, credentials or unnecessary sensitive data in questions or support requests.
• Do not attempt to access other accounts, bypass controls, introduce malicious code or automate abuse. Normal plan use within included invoice periods is not measured by document or conversation count; resale and automated abuse are not included.
• Keep the copies and evidence your business must retain. Do not delete an original until you have verified the upload and your own copy.

Creating an account is not itself a payment order. Before confirming in Stripe, you will see the plan, billing frequency, total amount and applicable tax treatment based on the information supplied. Check those details; if there is an error, do not confirm and contact support. Billing documents must identify the provider and legally applicable taxes.

Where a plan offers a 14-day trial, it requires a card and automatically converts to the selected monthly or annual period when it ends, unless canceled beforehand. Eligibility and any absence of a trial must be displayed before confirmation. Each renewal charges for the contracted period. “Cancel anytime” must not be understood as a promise of an automatic refund for a period already started.

You can manage renewal and your payment method in Settings → Billing, with payment details managed through Stripe. If you cannot access it, email support@factivo.ai. Canceling renewal and deleting an account are separate actions. Check the end date displayed by the portal and retain its confirmation. Mandatory refund or termination rights take precedence.

Monthly subscriptions include the calendar quarter in which service starts and quarters reached while the subscription remains active. A September signup includes July and August. Annual subscriptions include backfill for the signup fiscal year and twelve months of service from the start of the paid annual term; they do not end on December 31. The annual price is paid upfront and renews annually unless cancelled.

Automatic mailbox searches are limited to the current fiscal year, beginning January 1 or your autónomo establishment date if later. Coverage follows the invoice date, not its upload or email delivery date. The same rules apply to connected providers and manual uploads. The trial includes the current quarter; annual historical coverage starts when the annual payment succeeds.

On monthly, eligible earlier quarters in the current fiscal year may be purchased separately for the one-time price displayed before payment. Availability and the final total are shown before confirmation. Already covered quarters are not charged again. Processing new or late documents requires active service even when their quarter was previously purchased. Keep your establishment date accurate.

Cancelling renewal preserves service through the paid term. After it ends, saved documents, originals and exports remain accessible without a subscription, including purchased backfill. New uploads, edits, invoice processing, syncing and Agent work stop. Resubscribing restores processing subject to your included periods; it does not purchase missing quarters automatically.

We do not offer discretionary refunds for unused subscription time or completed backfill. Mandatory withdrawal, conformity and termination rights remain unaffected. Contact support about billing errors or a service that was not supplied as agreed. See the refund policy.

Archive access applies while your account and records are retained. Cancelling does not delete the account. Account deletion, removal requests and lawful retention follow the privacy policy; this is not a guarantee of indefinite storage.

Your statutory rights are not excluded. For distance contracts, the general withdrawal period is 14 calendar days from contracting, subject to applicable legal conditions and exceptions. A free trial does not replace this right. Activating an account does not itself constitute a waiver or full performance of an ongoing service.

To withdraw, send an unequivocal statement to support@factivo.ai, identifying yourself, your account email, service and contract date. Example: “I hereby withdraw from my contract for [service], entered into on [date], in the name of [name], email [email], date of this notice [date].” You do not have to use this template. Do not send full card details.

Refunds, any proportional amounts for performance begun at your express request, and exceptions apply only where permitted by law and where the necessary information and requests have been provided. Statutory guarantees of conformity for digital services remain in force. You may complain through support and use the mechanisms and authorities available under applicable law.

You can request the return of your records and documents and export them from Account. Structured data does not replace originals; check both before closing the account. For export or provider-switching assistance, contact support and identify the requested format or destination. You do not need a new plan to exercise access, export or deletion rights.

Where the EU Data Act applies, rights concerning switching, assistance, notice, transition and retrieval are governed by that regulation and must be specified in the service agreement. This text does not imply that a destination provider reproduces all Factivo features. Technical limitations must be explained before switching; retrieval cannot be made conditional on consent to new AI features.

Erasure does not include documents that must be retained with restricted access to meet a legal obligation or justified claims during the applicable period. Isolated backups and processors have separate cleanup procedures. See the privacy policy and request the status of a request if you need confirmation.

Maintenance, provider failures or changes required for security and compliance may occur. Restrictions must be proportionate; data and recovery options must not be lost because features are suspended. Material price or term changes must be communicated with the required notice and options before taking effect. A new version does not itself authorize unrelated processing or unaccepted charges.

No liability is excluded or limited where the law prohibits doing so. Review notices and technical limitations do not remove the provider’s obligations or mandatory rights. Any additional contractual limit requires valid assessment and agreement; this text does not grant immunity from claims.

Internal TestFlight builds may be incomplete, change or expire. Invitations are personal and do not authorize distribution to others. Installing TestFlight does not itself create a subscription; an existing web subscription is managed separately. Data protection and mandatory rights also apply to testing with real data.

Applicable law and competent courts are determined by the relevant legal rules without depriving consumers of mandatory protections. No general waiver of claims, jurisdiction or privacy rights is imposed.
